This User Agreement (the "Agreement") is a legally binding document between [Elysian Tech Limited] ("we", "us", or "our") and the user ("you") of the AuraFace mobile application ("this App"). It governs your rights and obligations while using this App.
By downloading, installing, registering, logging in, or using this App, you signify that you have fully read, understood, and agreed to be bound by all terms of this Agreement and comply with Google Play Developer Program Policies and relevant local laws and regulations. If you do not agree to this Agreement, please immediately stop downloading, installing, and using this App.
1.1 Service Content: We provide you with various functional services as marked within the App, including but not limited to account management, content browsing, and user-generated content posting. We reserve the right to add, modify, or terminate part or all of the services at any time based on business adjustments, technical upgrades, or policy requirements, and will notify you through prominent means such as pop-ups or announcements within the App.
1.2 License: We grant you a limited, non-exclusive, non-transferable, revocable license to use this App solely for personal, non-commercial purposes. You agree to use the services strictly in accordance with this Agreement and relevant operation rules, and shall not engage in unauthorized reverse engineering, decompilation, cracking, or modification of this App.
2.1 User Qualification & Accuracy of Info: You represent that you are at least 13 years old, possess the corresponding capacity for civil conduct, and assume full legal responsibility for your actions using this App. When registering or using the services, you should provide true, accurate, and complete information and update it in a timely manner. Service restrictions or losses resulting from untrue or incomplete information shall be borne solely by you.
2.2 Prohibited Conduct: You shall not engage in the following while using this App: violating local laws, public order, or good morals, or spreading illegal, obscene, violent, or discriminatory content; infringing upon our or third-party intellectual property, trade secrets, or other legal rights; unauthorized collection, use, or sharing of others' personal info, or violating Google Play user data processing policies; using malicious programs or plug-ins to interfere with the App's normal operation, or attacking our servers and systems; engaging in fraudulent activities, artificial traffic inflation, or promoting spam.
All content of this App (including but not limited to source code, interface design, graphic materials, trademarks, logos, etc.) belongs to us or our licensors and is protected by copyright, trademark, and other relevant laws and international conventions. Without our prior written consent, you shall not copy, distribute, modify, sub-license, or utilize the aforementioned content in any form.
The copyright of user-generated content you post within the App belongs to you, but you grant us a worldwide, non-exclusive, royalty-free license to use it for the App's operation, promotion, and service optimization, with the right to perform reasonable editing and adjustments to the content.
We value the protection of your personal information and will strictly comply with Google Play user data policies and international regulations such as GDPR and CCPA. We employ industry-standard security technologies and management measures to protect your data from unauthorized access, disclosure, or tampering. We process your data only within the scope of purposes specified in this Agreement and our Privacy Policy, and will not sell or rent your personal info to third parties (except with your authorization or required by law).
5.1 Service Disclaimer: This App provides services on an "as is" basis. We do not guarantee the continuity, stability, or error-free nature of the services, and assume no liability for indirect, incidental, or punitive damages resulting from technical failures, system maintenance, or network issues.
5.2 Third-Party Disclaimer: This App may contain third-party links, SDKs, or services. We assume no responsibility for the content, services, or privacy policies of third parties, and you interact with third parties at your own risk.
5.3 User Behavior Disclaimer: Any losses to yourself or third parties resulting from your violation of this Agreement, relevant laws, or abuse of the service shall be borne solely by you, and we reserve the right to seek compensation from you.
6.1 Modification: We have the right to revise this Agreement based on legal changes, business adjustments, or policy requirements. Revised agreements will be posted within the App and take effect from the date of posting. Your continued use of the App signifies acceptance of the revised Agreement.
6.2 Termination: You may apply to cancel your account at any time. If you seriously violate this Agreement or Google Play policies, we reserve the right to freeze or cancel your account and terminate services without compensation. Upon termination, we will delete or anonymize your data according to our Privacy Policy (except as required by law).
This Agreement is governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute arising from or related to this Agreement shall first be resolved through friendly consultation; failing which, either party has the right to file a lawsuit with the court of competent jurisdiction where we are registered.
Headings are for convenience only. If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure or delay in exercising any right under this Agreement does not constitute a waiver of such right. This Agreement constitutes the entire agreement between the parties regarding the use of the App.
